Groups File Lawsuit Challenging Delay of Greenhouse Gas Reporting Program
WASHINGTON, OCTOBER 23, 2026 – Environmental Defense Fund and Environmental Integrity Project have filed a lawsuit challenging the Trump EPA’s latest delay of the Greenhouse Gas Reporting Program – the vital source of information about the pollution that causes climate change and increases risks to people’s lives, health and money.
“Climate change is making life less healthy, more dangerous and more expensive for all Americans. The Greenhouse Gas Reporting Program provides information that is important for addressing climate change, but the Trump administration has repeatedly tried to bury that information by unlawfully delaying the program,” said Edwin LaMair, Senior Attorney for Environmental Defense Fund. “Blocking information about pollution will not make climate change disappear – it will just make it more expensive and difficult to deal with.”
Background
For more than 15 years, EPA’s Greenhouse Gas Reporting Program has provided reliable and comprehensive data about climate pollution from some of the largest sources in the U.S. That information provides vital transparency and helps to protect people from a wide range of damages caused by climate change – from worsening floods, fires and heat waves to rising insurance costs. The program is used by companies, policymakers, and people across the country.
Last year, the Trump EPA shut down the Greenhouse Gas Reporting Program’s portal for more than a month without explanation and then unlawfully tried to delay the deadlines for companies to report their climate pollution. Environmental Integrity Project obtained the data through public records requests and published it in a comprehensive analysis.
The Trump administration also refused to release the U.S. Greenhouse Gas Inventory – an annual accounting of pollution that uses Greenhouse Gas Reporting Program data. Environmental Defense Fund got the inventory through the Freedom of Information Act (FOIA) and made it publicly available on its website.
Earlier this year, the Trump EPA issued another unlawful deadline extension for the Greenhouse Gas Reporting Program. Environmental Defense Fund and Environmental Integrity Project filed a lawsuit challenging that delay.
Yesterday the two groups filed a second lawsuit in the U.S. Court of Appeals for the D.C. Circuit challenging the most recent delay, which further extends reporting deadlines to March of 2027. The Trump EPA has also proposed getting rid of the Greenhouse Gas Reporting Program altogether – a move that dozens of groups, business interests and states have vigorously opposed.
With more than 3 million members, Environmental Defense Fund creates transformational solutions to the most serious environmental problems. To do so, EDF links science, economics, law, and innovative private-sector partnerships to turn solutions into action. edf.org
